Step #1 – Learning & Building The Case

The art of the case is the combination of knowledge, strategy, and execution that goes into a successful lawsuit, especially in a medical malpractice case. It starts with a deep understanding of the facts and laws related to the case. Then it progresses to building a strong case, utilizing experts, developing custom medical illustrations, conducting depositions, and pre-trial preparation. A successful law firm will be able to use all of these elements to give its client the best possible chance of success in the courtroom. The pre-trial process is also fundamental; it’s the practice and preparation before the trial. At this point, we go over your witnesses and what their testimony is going to be. Then, we review our exhibits and how we’ll present them to jurors and hone your case in chief. Step #2 – Making The Case

When making the case, you must have all your ducks in a row. Mandatory mediation is required in New Hampshire before the case goes to trial. However, before that happens, you must do your reconnaissance. You need to know who the insurance adjuster is, what motivates them, if there is an excess policy, and who the appropriate mediator should be if there are multiple defendants.

For this reason, a comprehensive PowerPoint presentation is created to demonstrate our capacity to execute the case in front of a jury. This presentation should include all the evidence and exhibits, just like you would in a closing argument. In addition, it should be organized, professional, and visually appealing so that you can make a strong impression on the adversaries.

Once the presentation is complete, you will be ready to enter mediation and present your case. Again, having an experienced law firm by your side can give you the confidence and support needed to present your case in the best possible light.

Step #3 – Closing The Case

Once thoroughly prepared and understood the case, it’s time to close it. Closing a case involves multiple steps, such as negotiation, mediation, and settlement.

Negotiation is an essential step in closing the case. The Granite Law Group understands the psychology behind negotiation and is knowledgeable in all of the different strategies. In addition, we have invested in taking classes at Harvard Business School on negotiation, which has helped give our firm an edge in negotiations.

Step #4 – Mediation and Settlement

Mediation could be another step in this process. The goal is to present your case clearly and concisely to receive a fair and reasonable offer. Before entering into mediation, conduct a full-day focus group with community members to hear the evidence and deliberate as if they were actual jurors.

Finally, execute the case with structured settlement brokers who can present financial plans for clients to invest money in a tax-effective way. With a good strategy and preparation, you can see a net settlement recovery double, triple, or even quadruple in value. Your client can then decide how much risk they want to take when closing the case.
